Terms and Conditions

By booking a workshop or personal tuition and paying a deposit you (the “Participant) ”are acknowledging and agree to abide by the terms and conditions set out below. By accepting your booking and deposit, Antony Spencer Photograpy (“company”, “we”, “us” or “our”) agree to abide by these terms and conditions.

Please DO NOT book any hotels or make any other travel arrangements until you have had an email confirmation from Antony Spencer Photography (NOT PayPal) of acceptance of your booking. If we are unable to confirm the booking, even though you have had an email from PayPal confirming your payment, we will not be liable for any other costs you have incurred. We will refund in full your PayPal payment. This is because popular tours sell-out quickly and it is essential that we check the appropriate configuration of clients especially with regard to those tours with shared accommodation.

We reserve the right to refuse any booking without giving a reason.

If you book any workshop or tour listed on this website but booked through or run by any other photographer or company, the booking is subject to their terms and conditions and your contract is wholly with them. Any issues arising from such a booking must be taken up with them directly. These terms and conditions relate only to bookings made with and confirmed by Antony Spencer Photography.

Deposits and Balances - A non-refundable deposit is required to secure a workshop or place in the amount stated in the applicable description. The remainder of the balance will be due no later than 90days prior to workshop  or tour commencement.  Should the booking be made in the 90days preceding the workshop or tour, payment of the balance is to be made in full at the time of booking.

Should the balance fail to reach Antony Spencer Photography or co-leader after this time we reserve the right to treat the booking as a cancellation and retain the deposit and re-sell the place on the applicable workshop or tour.

Amendments  - An administration charge of £50 may be made for amendments or alterations to a booking.

Transferring to an alternative tour - the transfer of a booking from one workshop to another is at our discretion and will incur an administration fee of £50.  A request to transfer must be made made more than 90 days prior to departure should be notified in writing via email or using the contact form on the website.

Cancellation - any cancellation must be notified in writing via email or using the contact form on the website . In the event of a cancellation we will reasonably attempt  to re-sell the workshop or tour place and if a direct substitution can be made all of the participants money will be returned minus the deposit. If the place cannot be re-sold then the potential workshop participant will remain liable for the full costs if within 90 days prior to workshop or tour commencement. It is advisable for each Participant to insure against such circumstances, particularly for overseas workshops.

We reserve the right to alter or cancel any tour or workshop. Should an alteration or cancellation become necessary, you will then have the choice of accepting the change, taking an alternative tour or workshop (and where this is of a lower price we will refund the difference), or withdrawing from the contract and accepting a refund of all monies paid to us. For the avoidance of doubt, as we are not party to any travel arrangements or accommodation that you make yourself and have received no payment for the same, we will not refund the costs of these in the event of a necessary cancellation. 

Itineraries  - Due to the nature of landscape photography, itineraries can change, for this reason the outline itinerary and tour/workshop description must be taken as an indication, and not as a contractual obligation only. Whilst every effort will be made to follow a tour itinerary as closely as possible, unforeseen circumstances beyond our control, such as but not limited to, war threats of war, riots, terrorist activity, industrial disputes natural or nuclear disaster, epidemic, fire, flood or adverse weather (“Force Majeure”) may prevent access to certain locations and Antony Spencer Photography cannot be held responsible for lack of photographic opportunities as a result. In the event of Force Majeure, whether prior to departure or during a workshop or tour, no refund shall be payable. 

Please note: On any Northern European workshops to photograph Aurora Borealis, sightings are not guaranteed and Antony Spencer Photography does not guarantee sightings of the Northern Lights.

Travel Arrangements - It will be the workshop participant's responsibility alone to ensure they arrive at the workshop destination airport. Antony Spencer Photography cannot be held responsible for lack of punctuality, delayed or cancelled flights due to adverse weather conditions, or any problems in transit. The workshop commences upon departure with Antony Spencer Photography from the destination airport/port. If a Participant fails to arrive at a destination for any reason whatsoever the workshop must proceed without them for the benefit of the other Participants.  

Airport and hotel transfers - transfers to and from airports and hotels are only included in the price when connected to flights as specified by Antony Spencer Photography. The Participant will be liable for transfers relating to unspecified flights.

Passports and travel visas - It is each participants responsibility to ensure they are in possession are a current valid passport and have the  all visas, permits and certificates, including medical certificates required into for the duration of the workshop. . All information and advice given by us on visas, vaccinations, climate, clothing, baggage and equipment is given in good faith.

Equipment and Loaned Items - Any loaned items of equipment is the sole responsibility of the workshop participant until returned to Antony Spencer Photography or workshop co-leader. By accepting use of any equipment you agree to pay for any damage caused to such equipment whilst in you care or a replacement as appropriate and at our sole discretion . If the item is no longer manufactured this applies to the latest suitable item even if the value of this item is considerably higher.

Participant Numbers - for certain tours a minimum number of bookings is required to enable to tour to go ahead. Any requirement for a minimum number of participants shall be specified in the tour description and will be done at a minimum of 30 days prior to the departure date. If cancellation of a tour is necessary for this reason please see Cancellation paragraph above, which will become applicable.

In the event of the specified tutor being unable to attend due to illness or other circumstances beyond our control, another tour leader may be provided. If this is not possible, then the tour or workshop will be cancelled and the provisions detailed in the above Cancellation  paragraph will come into effect.

Liability

Antony Spencer Photography and workshop co-leaders do not accept any responsibility for accidents, injury, death, carelessness, negligence or lack of punctuality attributable to any workshop Participant(s) or any other person unless this arises from the negligence of the tour / workshop leader or co-leader acting in the course of their employment. Any claims will be subject to United Kingdom law in respect of any question of liability and all proceedings will be within the exclusive domain of the United Kingdom courts. 

Every effort will be made to ensure the personal safety and well being of every workshop participant. By completing a booking form each workshop or tour Participant is doing so understanding the general risks of landscape photography and agree to comply with the decisions of the workshop leader or co-leader if applicable at all times. Such decisions will always be intended to keep all participants as safe as reasonably possible thought the duration of a workshop or tour.

Tours which involve travelling to such varied and exciting locations require extreme safety awareness at all times. Extra care will be taken by the workshop leader and co-leader to ensure participant safety but an extra level of precaution will be required by each participant. By acknowledging these terms and conditions and attending a tour or workshop you agree that you understand the potential for adverse weather including but not limited to snow, water, ice and extreme cold or heat and that you as the participant are responsible for your own safety and well being. Antony Spencer photography  cannot be held responsible for accidents, injury and carelessness due to such conditions. 

Insurance

Travel, personal and equipment insurance is the responsibility of the workshop or tour Participant and is not provided by Antony Spencer Photography. It is the responsibility of the workshop participant to ensure that they have the appropriate level and duration of insurance and medical cover.

It is a term of the contract between us that you will obtain the appropriate travel insurance cover before you set out on the tour or workshop . The insurance must cover the loss, expenses and damages arising from, including but not limited to, the cancellation of the tour or workshop (whether in whole or in part), insolvency, insolvency of a third-party provider, personal accident and injury, medical and repatriation costs (for overseas tours), loss of baggage and personal money and belongings and flight cancellations and delays.

Contract Performance - Any perceived failure in the performance of this contract must be communicated immediately to Antony Spencer or any co-leader to enable a satisfactory solution to be achieved at the earliest opportunity. Should this not be possible, any complaint you should be made in writing within 28 days of the completion of the tour or workshop.

Currency fluctuations

Each trip is built and priced on the current valuation of the GBP at the time of launch on the website. If over time the value of the currency declines by over 3% with evidenced source to be determine by us, then a surcharge can be levied to cover the entire cost of the deficit at the discretion of Antony Spencer Photography to protect from extreme abnormal volatility. Each Participant would be required to cover these costs if necessary, similarly if the value of currency improves any benefit will be passed to the Participant.

By making a booking, you are agreeing to accept all the above conditions. Any person making a booking does so on behalf of all the Participants included within it, so that all are bound by the booking conditions.
